Abstract

This paper explores how the world is losing its legitimacy, which is becoming eroded due to its complacent act of witnessing human rights violations folding rapidly in Gaza and Palestine without taking any appropriate action. The authors use an in-depth, extensive analysis approach of all the variety of mechanisms, approaches and practices used by the Israeli occupation of the Palestinians in the strip of Gaza, specifically since the October, 2023 war started. The extensive review focused on all the types of deeds that the Israeli occupation used since the first four months of the war, i.e. from the collective punishments, to war crimes, to forced displacement, to testing all types of munitions on Gazans, to harsh prisoners’ treatment, to forced displacement mechanisms, to ethnic cleansing, till the clear genocide actions. This study employs a qualitative approach, relying on a wide array of sources, including international law documents, reports from human rights organisations, scholarly articles, and firsthand accounts. Legal scrutiny of the instances of collective punishment discussed in this paper demonstrates a significant gap between the ideals of international humanitarian law and the realities of enforcement. The lack of accountability for violations, partly due to political and diplomatic complexities, challenges the efficacy of existing legal frameworks in safeguarding civilian populations and is making the whole world lose its legitimacy of having an international legal mechanism that can effectively address and deter the use of atrocities that start from collective punishment till genocide. Therefore, the paper concludes with a call to the international community for a reevaluation of existing legal and humanitarian responses capacity to all what is considered to clear utmost violation of human rights that start with collective punishment but can reach to forced displacement and genocide. It is a must if the world wants to re-claim its legitimacy as a more civilised world than the medieval.
